Here is how consultations are embedded into the policy and regulatory development: REGULATORY DEVELOPMENT AND REVIEW PROCESS CONSULTATIONS Policy development (early consultations) Early consultations on the issue identification and on the instrument choice. At this stage, consultations usually take the following forms: • Policy Paper; or • Preliminary Issue and Consultation Assessment (PICA) Information session or Q&A sessions may also be organized. Regulatory development (early consultations) Early consultations on the regulatory proposal. At this stage, the regulatory proposal is described but there is no legal text provided, as the consultation results contribute to shape the proposed solution (i.e., regulatory proposal). At this stage, consultations usually take the following forms: • Notice of proposed amendment (NPA) • Task team Information session or Q&A sessions may also be organized. Pre-publication in part I of the Canada Gazette This is typically the last consultation of the regulatory process, unless (1) The Governor in council TBS grants TC with an exemption from pre-publication in CGI, in which case the last consultation conducted during the regulatory development phase is the last consultation (e.g. exceptions are granted in cases where it is urgent to address a given issue or for low impact proposals); or (2) A high volume of comments received through the CGI consultation leads to major changes that justify a second consultation through CGI. Publication in part II of the Canada Gazette At this stage, there are no consultations. Management of the regulations While the regulations are in place, Canadians and the industry can continue to provide feedback on issues that need to be addressed. • Review of the regulations Planned review of the regulations do take place, such as the reviews of the Standing Joint Committee on the Scrutiny of Regulations (SJCSR). Departments also proceed to reviews of the regulations, like the recent ‘’Regulatory Review of the Canadian Aviation Regulations’’. Those review exercises include consultations to identify problems and irritants and include consultations such as Task Teams to identify potential solutions. To fix problems in the existing regulations, the regulations must be amended. This is done by going through the policy and regulatory development process again (including conducting consultations on the proposed amendments). Temporary fixes can also be made through the issuance of regulatory exemptions. Here is how the input collected through a consultation feeds into the regulatory project: 1. The consultation takes place (Policy paper, PICA, NPA, Task Team, etc.) 2. Input received (either via written submissions or during face-to-face meetings) is compiled and provided to the technical expect and regulatory analyst. 3. The technical expert and regulatory analyst complete a joint review of every comment received and determine whether the comment is in-scope and, if it is, identified whether a modification to the regulatory proposal would be adequate. 4. The regulatory proposal is amended as required. 5. A consultation report (a Bulletin or a What we heard report) is developed and published to provide a feedback loop on consultations. 6. A summary of the consultation process and results is included in the RIAS that is later published in part I and in part II of the Canada Gazette.
